For some reazon The Windows accept transparency when its maximized... other wise it doesnt. Any way to fix it?

Sorry, but i have a weird problem, the Theme its working perfectly, but, when i close a window and appear the desktop, my taskbar changes of color, when i re-open a window its transparency returns, why?
The taskbar transparency only work when a windows its open?

It is weird, if im on desktop my taskbar still transparent. My vista is ultimate, what urs? Maybe because the version of windows u have..

Is this because I'm using a home edition premium ? So I won't be able to get a correct taskbar, am I right ?
